Marco Quina is Head of Intellectual Property at Ginkgo Bioworks, a Boston-based synthetic biology company that provides cell programming tools and services to customers across industries including therapeutics, agriculture, and manufacturing. At Ginkgo, Marco advises on licensing, customer agreements, patent strategy, freedom to operate, trademark matters, and IP-related disputes. He works closely with scientists and business teams to develop licensing and technology transfer strategies, and has negotiated numerous licensing and collaboration agreements.
Before joining Ginkgo, Marco was a partner in the IP litigation group at Foley Hoag LLP, where he spent nearly 20 years representing life sciences clients in patent, licensing, and inventorship disputes in federal and state courts. He co-authored an amicus brief to the U.S. Supreme Court in Kimble v. Marvel Entertainment, the Court’s most recent decision addressing post-expiration patent royalties. He has advised clients both in-house and in private practice on navigating the limits imposed by Brulotte/Kimble and structuring agreements to mitigate related risks.
